3. When do we process data

  1. You create an account on the Website.
  2. You purchase a service, book an appointment, or use the User Panel.
  3. We perform a remote optimization service (AnyDesk + communication on Discord).
  4. You use technical support after the service (mainly via Discord).
  5. You place an order for the computer assembly service (including shipping).
  6. You contact us (contact form, e-mail).
  7. You visit the website (cookies/analytics/marketing).
  8. You use anti-spam protection features, in particular Google reCAPTCHA.

4. What data do we process

  1. Account and User Panel: e-mail, password (in a secured form), first and last name, phone number, country and time zone, Discord nick.
  2. Orders and remote service execution: service status, appointment date, service/package name, language, order connection, client data related to the service (e-mail, name, phone), AnyDesk data provided by the user.
  3. Payments and transactions: transaction data (amount, currency, date, payment and order identifiers) and payment status.
  4. Invoices: private individual (first and last name and address), company (NIP, name, address, EU VAT). Invoice data can be saved in the account.
  5. Computer assembly / shipping: first and last name, delivery address, e-mail, phone number, tracking number. The assembled computer is shipped via a shipping intermediary (Furgonetka.pl).
  6. Data collected automatically (cookies/pixels): IP address, cookie identifiers, device/browser identifiers, website events.
  7. Auxiliary materials (screenshots): taken occasionally for analysis or documentation purposes (e.g., BIOS/UEFI settings), unpublished, stored securely, and deleted no later than after 360 days.

5. Is providing data mandatory

  1. Providing data is voluntary, but in practice necessary to: create an account, securely and efficiently perform the service, and issue an invoice.
  2. Data required by law (e.g., tax law) must be processed to the extent specified by the regulations.

6. Data source

  1. You provide the data directly to us (e.g., during registration, purchase, entering invoice details, or contact).
  2. Technical and statistical data may be collected automatically by cookies/pixels — according to your consent settings in the cookie banner.
  3. We receive payment statuses and transaction identifiers from the payment operator (Stripe).

7. Purposes and legal bases for processing

  1. Account creation and User Panel operation - basis: performance of a contract / actions prior to entering into a contract.
  2. Conclusion and performance of a contract (purchase, appointment booking, service execution, technical support) - basis: performance of a contract.
  3. Organizational contact (e-mail/SMS) related to the service - basis: performance of a contract and our legitimate interest (efficient service and security).
  4. Payments (Stripe) and settlements - basis: performance of a contract.
  5. Invoicing, accounting, tax obligations - basis: legal obligation.
  6. Complaints, claims, defense against claims - basis: legitimate interest.
  7. Analytics and marketing (GA4, Meta Pixel, TikTok Pixel) - basis: consent to cookies/tracking technologies.
  8. Securing forms and the website against bots, spam, abuse, and fraud attempts using Google reCAPTCHA. Legal basis: our legitimate interest in ensuring the security of the Website, preventing abuse, and protecting against spam and unauthorised traffic.

8. Data recipients

  1. Infrastructure and security providers (e.g., Cloudflare).
  2. Payment provider (e.g., Stripe).
  3. Providers of analytical and marketing tools (e.g., Google/Meta/TikTok).
  4. E-mail and SMS service providers.
  5. Communication and remote access providers (e.g., Discord/AnyDesk).
  6. Shipping intermediaries and carriers (e.g., Furgonetka.pl).
  7. Entities providing accounting/legal services.
  8. Public authorities - when required by law.

9. Social media

  1. We maintain profiles on social media (Facebook, Instagram, TikTok, YouTube).
  2. If you contact us via social media, we may process data visible on your profile and the content of the correspondence — solely to answer your inquiry.
  3. Formal matters, including complaints, GDPR requests, and contract withdrawal, are handled exclusively via e-mail: [email protected].
  4. Social media platform providers are independent data controllers. Their data processing rules arise from their own privacy policies.

10. Data transfer outside the EEA

  1. Some providers may process data outside the European Economic Area (EEA).
  2. In such cases, appropriate safeguards are implemented, including Standard Contractual Clauses (SCC). Information on these safeguards is available upon request.

11. How long do we keep the data

  1. Account and profile data - until the account is deleted by the user.
  2. Billing data and invoices - for the period required by tax/accounting regulations (generally 5 years).
  3. Correspondence (e-mail/Discord/SMS) - for the duration of the account and service support, as well as for the time needed to establish, pursue, or defend claims.
  4. Cookies/analytics/marketing - according to cookie tool settings and until consent is withdrawn.
  5. Deleting the account in the Panel results in immediate access deactivation. The process of full deletion/pseudonymization of data in systems and backups may take up to 90 days.

12. Call recording and training materials

  1. As a rule, we do not record remote sessions or conversations.
  2. If we exceptionally record a fragment of a conversation for training and quality purposes, we inform you before the recording begins.
  3. Recordings are not published, access is restricted solely to authorized personnel, and they are deleted no later than after 360 days.

13. Your rights

  1. You have the right to: access your data, rectify, delete, restrict processing, and request data portability.
  2. You have the right to object to processing based on legitimate interests and to withdraw consent at any time (if processing is based on it).
  3. You have the right to lodge a complaint with the supervisory authority (PUODO in Poland).
  4. Requests regarding personal data are processed via contact at: [email protected]. We respond without undue delay, no later than within 1 month.

14. Cookies and analytical/marketing tools

  1. The Website uses cookies and similar technologies to ensure proper site operation, security, analytics, and marketing.
  2. We use cookies: necessary (technical, no consent required), functional, analytical (activated upon consent), and marketing (activated upon consent).
  3. We use in particular: Google Analytics 4 (GA4), Meta Pixel, TikTok Pixel, Google reCAPTCHA (anti-bot protection), and Google Tag Manager.
  4. Consent for analytical and marketing cookies is expressed in the cookie banner (Accept/Reject/Settings) and can be withdrawn at any time.
  5. You can also manage cookies from your web browser settings.
  6. If we launch e-mail marketing (newsletter) in the future, it will be based on a separate, voluntary user consent.
  7. The Website uses Google reCAPTCHA as a tool to protect forms and the site against spam, bots, abuse, and fraud attempts. In connection with how reCAPTCHA operates, technical data relating to the user and their device may be processed, in particular the IP address, browser information, operating system, device settings, and data related to interaction with the form or site. This data is processed for the purpose of verifying whether a given form or site is being used by a human and not an automated system.

15. Automated decision making and profiling

  1. We do not make decisions affecting users that produce legal effects solely on an automated basis (including profiling).
  2. We may use marketing tools to display tailored ads and measure campaign effectiveness - exclusively after you consent to marketing cookies.

16. Data security

  1. We apply technical and organizational measures appropriate to the risk (including access control, infrastructure security, spam protection).
  2. Remote access to the computer is carried out exclusively with the user's consent and to the extent necessary to perform the service.
  3. We do not browse the user's private files beyond what is necessary to perform the service. The user can terminate the remote session at any time.

17. Rules regarding minors

  1. The Website is intended for persons who are at least 16 years old.
  2. Persons under 16 years of age may use the Website exclusively through a parent or legal guardian (in particular regarding granting consents).

18. Privacy policy changes

  1. The policy may be updated in the event of changes in Website features, providers, or legal regulations.
  2. The current version is published on gainfps.com.
